This Acceptable Use Policy (“Policy”) is part of Givable’s Terms of Service (“Terms”). It applies to everyone who uses the Services, including Organizations, their staff and volunteers, peer-to-peer fundraisers, and Donors. Capitalized terms not defined here have the meanings given in the Terms. A violation of this Policy is a violation of the Terms.
An Organization is responsible for making sure that its users, and the people who fundraise or post content on its behalf, follow this Policy.
1. Organizations and accounts
- Use the Services only for the charitable purposes of the verified Organization that holds the account.
- Keep one account per legal entity. Each subaccount must be a separate legal entity with its own tax identification number (such as an EIN or Business Number) and its own payment processor account.
- Do not create an account or subaccount to get around a suspension, a limit, verification, or a fee.
- Do not share login credentials. Invite each person as their own user; activity under a user’s credentials is that user’s and the Organization’s responsibility.
- Do not resell, sublicense, or operate the Services for an organization that does not hold its own Givable account.
2. Fundraising and payments
- Describe campaigns, beneficiaries, and how funds will be used accurately. Do not make misleading claims about urgency, impact, or matching gifts.
- Accept payments only for your own Organization. Do not process transactions for another person or business, or use the Services to move funds that are not contributions, event sales, or merchandise sales for your Organization.
- Connect only a payment processor account that your Organization owns and controls.
- Classify each item accurately as a donation, admission ticket, table or group package, sponsorship, or merchandise or add-on. Do not relabel, split, or combine items to reduce fees. Givable may reclassify items and recalculate fees where an item is misclassified.
- Do not misrepresent how a payment was received, for example by recording a payment made through the Services as an offline gift, to avoid fees.
- Do not accept payments from, or direct funds to, people, entities, or places subject to sanctions, and comply with anti-money-laundering laws.
- Do not use the Services for card testing, fraudulent transactions, or activity intended to generate refunds or chargebacks.
3. Text messages and email
- Send marketing text messages only to people who have given consent that covers the messages you send, and keep a record of that consent.
- Honor opt-outs. Do not message someone who has replied STOP unless they opt back in themselves.
- Provide your Organization’s own, accurate legal details for carrier registration (such as 10DLC brand registration or toll-free verification), and send only messages that match the use case you registered.
- Do not spread messages across multiple numbers, accounts, or subaccounts to avoid carrier filtering or limits.
- Do not send group text messages, or content that wireless carriers or messaging industry guidelines prohibit.
- Do not work around quiet hours, frequency limits, or suppression lists that apply to your messages.
- Include your Organization’s valid physical postal address and a working unsubscribe option in every marketing email, and honor unsubscribes.
- Do not send to purchased, rented, or scraped lists, or to people who have not agreed to hear from your Organization.
- If you connect your own messaging provider account, your Organization is responsible for that account’s registration and compliance, and for any carrier fines or fees caused by messages sent through it.
Text messaging is available for phone numbers in the United States and Canada.
4. Content
Do not use the Services to post, upload, send, or link to content that:
- is illegal, or promotes illegal activity
- promotes hate, discrimination, harassment, or violence, or threatens or demeans a person or group
- is sexually explicit or shows graphic violence
- infringes the intellectual property, privacy, or publicity rights of others
- shows an identifiable person without their permission, or a minor without the permission of a parent or legal guardian
- discloses another person’s health information, precise location, contact details, or government identifiers without their consent
- impersonates a person or organization, or misrepresents your affiliation with one
- is designed to collect passwords, payment details, or personal information under false pretenses, including on a custom domain
- contains malware, viruses, or other harmful code
Organizations are responsible for the content their users, volunteers, and peer-to-peer fundraisers post on their pages, and must act on reports and removal requests within a reasonable time, including a request from a person to remove content that shows them.
Upload only files you have the right to use and that relate to your Organization’s fundraising and operations. Storage is not for general file hosting.
5. Givable AI
- Do not attempt to get around Givable AI’s safeguards, permissions, or spending controls, or use it to reach data you are not authorized to view.
- Do not use Givable AI to create deceptive fundraising claims, impersonate a person, or produce unsolicited bulk messages.
- Review AI output before you rely on it, publish it, or send it to anyone.
6. Security and platform integrity
- Do not probe, scan, or test the Services for vulnerabilities, or load-test them, without Givable’s written permission. Report security issues to security@givable.com.
- Do not bypass rate limits, bot protection, usage allowances, or access controls.
- Do not scrape the Services or access them by automated means other than the published API and export tools.
- Do not attempt to access another Organization’s account or data, or interfere with another Organization’s use of the Services.
- Do not copy, reverse engineer, or use the Services to build a competing product.
7. Fair use
- Users and contacts. Users are unlimited on every plan, with no per-seat charges. Contacts are unlimited too: on the Standard plan, up to 2,500 are included, and above that the published contact minimum applies, as described in Section 5 of the Terms. Platform fees count toward it, because Givable’s pricing depends on online giving being processed through the Services.
- Allowances. Plan allowances, including API calls, AI credits, and media storage, are for your Organization’s own use and may not be transferred or pooled with another account.
- Stability. Givable may rate-limit or throttle use that affects the stability of the Services, and bills use beyond an allowance at the published rates.
8. Reporting a violation
Report content or activity that you believe violates this Policy to help@givable.com. Report security vulnerabilities to security@givable.com. Copyright complaints follow Section 21 of the Terms.
9. Enforcement
If Givable believes this Policy has been violated, it may, depending on the circumstances, remove content or hold it from public display, pause specific features such as text messaging, reclassify items and recalculate fees, or suspend or terminate the account under Section 13 of the Terms. Givable may also share information with payment processors, wireless carriers, and law enforcement where required or where needed to prevent harm.
Where practical, Givable will notify the Organization and give it a chance to correct the issue. Givable may act without notice where a violation creates legal, security, financial, or carrier risk, or harms other users.
10. Changes to this Policy
Givable may update this Policy. Changes are made and communicated as described in Section 30 of the Terms.
